Divorce of Affleck and Garner highlights mediation

Divorce can be a challenging and, at times, even destructive experience to families experiencing it. Many Connecticut residents have seen first-hand what a costly divorce battle in a courtroom setting can do, particularly to children of the couple seeking to dissolve a marriage. With more and more high-profile celebrity marriages ending in divorce mediation rather than the courtroom, divorce mediation is in the spotlight.

Generally speaking, mediation differs from a standard divorce in one key way: the couple seeks to settle the specifics of their divorce out of court. That is not to say that legal representation is not involved -- the parties still retain their own individual counsel. However, instead of facing one another in front of a judge, a mediator is designated. A mediator is an individual trained to work with both spouses and their representation to facilitate an amicable settlement for both parties.

Ben Affleck and Jennifer Garner, the celebrity power couple currently facing a divorce, are taking this route. With several million dollars' worth of assets on the line, some people have expressed surprise that they would choose to eschew a courtroom. However, if their efforts at mediation are a success, others may consider courtroom alternatives as well.

Ultimately, each divorce situation is unique to the individuals involved in it. Connecticut residents understand that mediation is not always possible or appropriate in all situations. However, it can benefit both spouses to understand all their options before deciding on a course of action when it comes to ending their marriage. An amicable solution reached with a minimum of drama is often best for all involved, when circumstances warrant that approach.
