Unprecedented child custody decision made in another state

On Behalf of | Mar 15, 2017 | Child Custody |

What constitutes average Connecticut families nowadays looks a lot different than traditional families of long ago. Many children today are raised by single parents or by grandparents. While there are indeed still families where a mother stays home to raise the children and the father acts as sole breadwinner, the landscape of the American family has changed a great deal. As families evolve, so do child custody situations in divorce.

A recent ruling in another state has been considered the first of its kind. One of the people involved is actually appealing the ruling because he disagrees with it. It all has to do with a 10-year-old boy and three adults who have raised him.

The child considers all three people his parents. Two of them, a man and a woman, used to be married. During their union, they became involved with another woman from their neighborhood. She eventually carried a child for the three of them to raise together, as the married woman was said to be unable to bear children. The couple who was married eventually divorced; however, the former wife has been granted a share of child custody for the boy along with the two biological parents.

The father says he does not agree with the court’s decision because his former wife is not biologically related to his son. The court cited another case where an adoptive parent who divorced a biological parent was, in fact, granted custody of a child. This type of child custody decision may be the first of its kind in New York, but will likely not be the last; others are sure to follow, perhaps even in Connecticut. Anyone currently facing a difficult child custody issue in this state can seek guidance from an experienced family law attorney.
